Madonna sued over alleged 'Vogue' sample: report

Madonna is being sued by Delaware-based company VMG over her 1990 smash single, Vogue.

The company filed suit Wednesday against the Material Girl, and her record label, claiming she sampled portions of a 1977 song, called "Love Break," for her hit reports E! Online.

According to the suit: "The portions of Love Break, which have been copied into Vogue and all its various mixes, remixes, videos, YouTube versions, etc. are numerous but intentionally hidden. The horn and strings in Vogue are intentionally sampled from Love Break throughout."

VMG says its bringing the suit years later because it used technology available in 2011 to confirm the song had been sampled.

Music producer Richard "Shep" Pettibone remixed versions of "Love Break," and also later worked on "Vogue," E! reports, leading VMG to allege the producer, "intentionally disguised the sampling he did in Vogue.'"

The unauthorized sampling was deliberately hidden by [Madonna] within Vogue so as to avoid detection, the suit says.

VMG is seeking damages, "in addition to [Madonna's] profits that are attributable to the copyrighted material.

E! reports that Madonna and label WB records were sent notices of copyright infringement in July 2011, and again in February 2012.

The Material Girls team has yet to comment on the suit, according to a report by Rolling Stone.
